TrackPlate Terms of Use

These Terms of Use ("Terms") govern your use of the TrackPlate mobile application ("App") operated by TrackPlate ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Use of the App
TrackPlate provides tools to help users log meals and view estimated calorie and nutrition information. The App is intended for informational purposes only.
You must be at least 13 years old to use the App. If you are under 13, you may only use the App with the involvement of a parent or legal guardian, in compliance with applicable law (e.g., GDPR/K, COPPA).
2. Subscriptions & Payments
TrackPlate offers auto-renewable subscription options:
- Subscription Title: TrackPlate Pro
- Subscription Length: Monthly / Yearly
- Price: $9.99 per month or $79.99 per year in the US (prices may vary by region)
Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
You can manage or cancel your subscription through your Apple ID account settings after purchase. We do not manage billing or refunds directly.
3. Free Trials
If a free trial is offered, any unused portion of the free trial period will be forfeited when a subscription is purchased.
4. Nutrition Disclaimer
TrackPlate provides estimated calorie and nutrition information generated using AI-powered automated systems. This information may be inaccurate or incomplete and should not be relied upon as medical, dietary, or health advice.
TrackPlate is not a medical or healthcare application and does not replace advice from a qualified healthcare professional. Always consult a licensed healthcare provider for guidance on diet, nutrition, or medical concerns.
5. User-Generated Content
You may submit content such as meal photos or text entries (“User Content”). You retain ownership of your User Content.
By submitting User Content, you grant TrackPlate and its service providers a worldwide, transferable, sublicensable, royalty-free license to:
- Store your content securely in Supabase’s cloud infrastructure (hosted on AWS).
- Process your content using AI models, including Gemini, to provide App functionality and analytics.
Your content will be processed by Gemini to generate AI responses as part of the App functionality. Under the Google Cloud API terms we use, your content is not used to train Gemini’s underlying models without explicit consent.
Important: Do not submit content that is confidential, sensitive, or that you do not wish to be stored or used for AI processing.
6. Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we collect, store, and process data. By using the App, you consent to such data collection and processing.
Your User Content and other personal data may be stored and processed on servers located outside your country, including in the United States. By using the App, you consent to international data transfers as described in the Privacy Policy.
7. Termination
We may suspend or terminate access to the App if you violate these Terms or misuse the service. Upon termination, your license to use the App and your ability to submit content will end, but certain data may remain in our systems as described in the Privacy Policy.
8. Limitation of Liability
To the maximum extent permitted by law, TrackPlate shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to errors in nutrition estimates, loss of data, or any reliance on App functionality.
9. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of Germany. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Drensteinfurt, Germany.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We encourage you to review the Terms periodically.
11. Entire Agreement & Severability
These Terms, together with the Privacy Policy, constitute the entire agreement between you and TrackPlate regarding your use of the App. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
